Terms of Service

Welcome to MAXSTATS. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Athlete," or "you") and MAXSTATS ("we," "our," or "us"), governing your access to and use of the MAXSTATS mobile applications (iOS and Android), website located at maxstats.app, backend systems, and all related fitness tracking and gamification services (collectively, the "Services").

BY CREATING AN ACCOUNT, DOWNLOADING THE APP, OR ACCESSING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICES.

1. Eligibility and Account Registration

• Age Requirement: You must be at least 13 years old (or 16 years old in the European Union and United Kingdom) to use the Services.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Accurate Information: You agree to provide accurate, current, and complete registration details and keep your profile metrics up to date.

2. Important Health, Physical Activity & Medical Disclaimer

MAXSTATS IS NOT A MEDICAL DEVICE NOR A HEALTHCARE PROVIDER.

• No Medical Advice: The Services, including workout logs, 1RM calculators, AI body fat estimations, and training recommendations, are for informational and entertainment purposes only and do not constitute medical advice, diagnosis, or treatment.
• Assumption of Risk: Physical exercise involves inherent risks of injury, heart attack, or death. You voluntarily assume all known and unknown risks associated with your workouts, outdoor routes, and athletic training.
• Consult a Physician: Always consult a qualified physician before starting any new exercise program or if you experience pain, dizziness, or shortness of breath.

3. AI Body Fat Estimation & Machine Learning Disclaimers

• Estimations Only: Automated visual body composition analysis provided via Google Gemini API is an approximation based on 2D imagery and statistical models. It does not replace medical-grade DEXA scans or hydrostatic weighing.
• No Biometric Profiling: Uploaded physique photos are processed ephemerally without creating permanent facial recognition or biometric templates.
• Image Submission Rules: You agree never to upload images depicting nudity, minors, or non-consensual imagery.

4. User Conduct, Anti-Cheating & Leaderboard Integrity

MAXSTATS thrives on fair athletic competition and camaraderie. You agree that you will NOT:

• Spoof, manipulate, or fake GPS data, split times, or route coordinates on leaderboards.
• Submit fraudulent workout logs, unrealistic 1RM weights, or falsified volume metrics to gain unfair XP or ranks.
• Harass, intimidate, defame, or abuse other squad members or athletes.
• Reverse engineer, decompile, crawl, or scrape the Services or associated APIs.

5. User Content & Intellectual Property Rights

• Your Content: You retain ownership of workout logs, route coordinates, physique photos, and squad messages you submit. You grant MAXSTATS a non-exclusive, worldwide, royalty-free license to host, display, analyze, and format your content strictly to operate the Services.
• MAXSTATS IP: All app designs, logos, software code, XP algorithms, badge artwork, and visual assets are the exclusive property of MAXSTATS protected by trademark and copyright laws.

6. Squads, Social Features & Community Guidelines

Squads allow athletes to train collaboratively. As a squad member or leader, you agree to foster a supportive environment. Squad leaders have the right to manage squad rosters. We reserve the right to disband squads or remove content that violates our Community Guidelines.

7. Outdoor GPS Tracking & Route Safety

When recording outdoor runs, cycling, or walks:

• Always remain aware of your surroundings, traffic, trail conditions, and weather hazards.
• Do not interact with your device while navigating dangerous roads or intersections.
• Use granular Privacy Visibility Controls if you prefer not to broadcast start and finish locations (e.g., your home address) to public feeds.

8. Third-Party Integrations & Services

Our Services integrate with Google Firebase, Google Cloud, and third-party map layer providers. Your use of integrated services is subject to their respective terms and policies.

9. Disclaimers of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. MAXSTATS DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAXSTATS, ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PHYSICAL INJURY, LOSS OF DATA, OR LOSS OF PROFITS ARISING FROM YOUR USE OF THE SERVICES.

11. Dispute Resolution, Mandatory Arbitration & Class Action Waiver

• Mandatory Individual Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) or JAMS.
• Class Action Waiver: YOU AND MAXSTATS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware.

12. Account Termination & Deletion

You may terminate your account at any time under Profile > Settings > Delete Account. We reserve the right to suspend or terminate accounts that violate these Terms or present a security threat to our community.
